If you FAILED the evidentiary test

  • If you FAILED the evidentiary test, you must request an
    Administrative License Suspension Hearing from the Idaho Transportation
    Department within SEVEN (7) days to contest the hearing. The issues you
    are raising must be stated in your request. Failure to request a
    hearing or failure to prevail at the hearing will result in the
    following driver’s license suspension:

    • If this is your FIRST failure, your license being suspended for
      90 days with no driving privileges during the first 30 days. The
      license suspension starts 30 days after you were arrested for Driving
      Under the Influence. You must apply for restricted driving privileges
      at the Idaho Transportation Department. (link)
    • If this is your SECOND failure within FIVE years, your license
      will be suspended for ONE YEAR with absolutely no driving privileges.
